These Terms govern access to and use of the MULTISEEK website and related services. MULTISEEK is an advertising, information, referral and reseller platform. Unless a page expressly states otherwise, MULTISEEK is not the merchant of record, does not collect or hold customer payments, and does not itself supply the third-party product or service.

1 About these Terms

In these Terms, MULTISEEK, MS, we, us and our mean MULTISEEK (ABN 14 977 556 780), trading as MULTISEEK. You and your mean each visitor, account holder, advertiser or other user of the Website.

By using the Website, creating an account or proceeding through a link, widget or referral tool, you agree to these Terms. You must be at least 18 years old and have legal capacity to enter into a contract. If you do not agree, do not use the Website.

The English version prevails to the extent permitted by law. Any translation is provided for convenience only.

2 Our role and third party transactions

The Website displays or links to offers, deals, promotions, advertisements, products and services provided by independent third parties. We may receive affiliate commissions, referral fees, advertising fees or subscription payments.

Unless we expressly identify MULTISEEK as the merchant or supplier before checkout:

• your purchase or booking contract is with the third-party merchant or supplier identified before payment;
• payment is made to and processed by that merchant, supplier or its payment provider;
• the third party controls acceptance, confirmation, fulfilment, delivery, availability, pricing, cancellations, refunds, warranties and customer service for its product or service; and
• MULTISEEK does not receive or hold your purchase money on trust.

The identity of the contracting merchant should appear on the offer, checkout, payment page, statement or confirmation. Do not proceed if it is unclear who will take payment or supply the product or service. Contact us before paying if you need assistance identifying the merchant.

We remain responsible for services we ourselves provide and representations we make. Describing our role does not exclude any responsibility that cannot lawfully be excluded.

3 Third party terms and privacy policies

A third-party transaction is governed by that party’s terms, including its price, delivery, cancellation, refund, returns, warranty, eligibility, safety and conduct requirements. You must read those terms and the third party’s privacy policy before purchasing, booking or providing personal information.

4 Listings search results rankings and advertising

MULTISEEK does not list every available business, product or service. A third party may be absent because it does not participate, accept online referrals, provide access to its inventory or have current capacity.

Unless a page expressly says otherwise, ordinary listings may be organised by category, date, relevance, availability or other displayed filters and are not a comprehensive market comparison. Where we publish rankings, comparisons, reviews or editorial selections, the relevant page may state the criteria used. Sponsored placements and advertisements will be identified where required by law.

Payment of a commission or advertising fee does not remove our obligation to avoid false or misleading representations. Inclusion is not a personalised recommendation and does not guarantee suitability, quality or availability.

5 Information prices offers and images

Descriptions, prices, images, availability and promotional information may be supplied by third parties and may change without notice. We take reasonable care when publishing information, but you must check final details on the merchant’s website before payment.

The merchant’s checkout controls the final price, currency, taxes, fees and inclusions. Your bank or payment provider may charge conversion or transaction fees. Images may be illustrative, seasonal or supplied by third parties and may not show the exact product, accommodation, conditions or experience.

Coupons and promotions are subject to third-party conditions and availability. If an offer appears inaccurate or is not honoured, contact the merchant and notify us so that we can review the listing.

6 Purchases bookings cancellations and refunds

Requests concerning payment, delivery, amendments, cancellations, returns, refunds, credits or chargebacks should be directed first to the merchant shown on the order or booking confirmation. MULTISEEK cannot approve or fund a third party’s refund unless expressly authorised or required by law.

A search result, advertisement or request to book is not confirmation. A transaction is confirmed only when the merchant issues a valid confirmation or accepts the order. Check all details promptly.

Third-party terms do not remove rights that cannot be excluded under the Australian Consumer Law. The available remedy depends on the circumstances, the contract and applicable law.

7 Travel products

For travel products, you are responsible for accurate traveller details, passports, visas, entry and transit requirements, vaccinations, arrival times and compliance with supplier safety, fitness, age and participation requirements. Check official travel advice, including Smartraveller, and consider insurance suitable for your circumstances. Insurance policies contain conditions and exclusions.

Travel suppliers may change or cancel services for reasons permitted by their terms, including weather, safety, operational constraints or insufficient participants. The relevant supplier or merchant is responsible for the remedy it owes under its terms and applicable law. We may provide reasonable referral assistance.

8 Accounts and user content

An account is optional unless a feature requires one. You must provide accurate information, keep login credentials secure and promptly notify us of suspected unauthorised use. You are responsible for activity through your account except to the extent it results from our failure to take reasonable security precautions.

If you submit a review, listing, image or other content, you confirm that you have the necessary rights and that it is lawful, materially accurate and not misleading, defamatory, discriminatory, abusive or infringing. You retain ownership and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it to operate and promote the Website.

We may moderate or remove content and suspend or close an account where reasonably necessary to enforce these Terms, protect users, address security risks, comply with law or discontinue a service. We will provide notice where reasonably practicable.

9 Acceptable use

• Do not use the Website unlawfully, fraudulently or in a way that infringes another person’s rights.
• Do not interfere with security, operation or access, or introduce malicious code.
• Do not scrape, crawl or use automated systems contrary to published instructions or in a way that places an unreasonable load on the Website.
• Do not impersonate another person, submit false information or misuse another person’s account.

10 Intellectual property

The Website’s original text, design, software, branding and compilations are owned by or licensed to MULTISEEK and protected by intellectual-property laws. Third-party names, logos, images and content remain the property of their respective owners.

You may access and print Website content for personal, non-commercial use. You must not reproduce, modify, distribute, sell, republish or commercially exploit it without permission, except where permitted by law.

11 Website availability and security

We may maintain, update, suspend or discontinue Website features. We do not promise uninterrupted, error-free or malware-free access, but we will take reasonable care in providing services we supply. You should use current security software and reasonable precautions when accessing online content.

12 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

Where MULTISEEK supplies a service to you, that service comes with any consumer guarantees that apply, including that it will be provided with due care and skill and, where applicable, within a reasonable time.

13 Liability

Subject to section 12 and to the maximum extent permitted by law, MULTISEEK is not liable for the acts, omissions, products, services, representations or insolvency of an independent merchant, supplier, payment provider or other third party, or for a contract to which MULTISEEK is not a party.

We are not liable for loss caused by your failure to follow these Terms or applicable third-party terms, or by inaccurate information you provide. We are not liable for indirect or consequential loss that was not reasonably foreseeable, except where liability cannot lawfully be excluded.

These limitations do not apply to loss to the extent caused by our negligence, fraud, wilful misconduct, breach of contract, misleading or deceptive conduct, or another liability that cannot be excluded by law.

14 Indemnity for misuse

To the extent permitted by law, you indemnify MULTISEEK against third-party claims and reasonable direct costs arising from your unlawful use of the Website, material breach of these Terms or infringement of another person’s rights. The indemnity is reduced to the extent MULTISEEK or another person caused or contributed to the claim or loss.

15 Privacy and communications

Our Privacy Policy is available at https://multiseek.com.au/privacy-policy/. When you request a referral or use a third-party tool, information may be provided directly to or disclosed to the relevant third party as explained at collection and in applicable privacy policies.

Electronic marketing will be sent only as permitted by law and will include a way to unsubscribe. Service communications about an enquiry or account are not marketing messages.

16 Complaints and contact

For a problem with a third-party purchase or booking, first contact the merchant shown on your confirmation. You may also contact us and we will provide reasonable referral assistance.

Please include your name, relevant order or booking reference, the merchant’s identity, a description of the issue and the outcome sought. Nothing prevents you from contacting NSW Fair Trading, the Australian Competition and Consumer Commission or another competent regulator or dispute-resolution body.

17 Changes to these Terms

We may update these Terms for operational, security, legal or commercial reasons. Updated Terms apply from the effective date displayed above and do not retrospectively change an already confirmed transaction unless required by law or agreed with you. We will provide reasonable notice of a material change to an account-based service where practicable.

18 Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts and tribunals with jurisdiction in New South Wales. This does not prevent a consumer from using another forum where applicable law permits it.

If a provision is invalid or unenforceable, it is read down to the extent necessary or, if it cannot be read down, severed. The remaining provisions continue.
